Terms of Service

Please read these Terms of Service carefully before using Timply. By accessing or using Timply, you agree to be bound by these terms. Timply (“we”, “our”, or “us”) is a subscription-based appointment booking platform operated by NovaTechBase LLC, a registered LLC in Virginia.

1. The Service

Timply is a subscription-based appointment booking platform for service businesses. It includes:

  • Online booking pages for businesses and their customers
  • Staff and availability management tools
  • Automated email and SMS appointment confirmations and reminders
  • Stripe-powered payment collection
  • AI voice booking agent for phone-based appointment scheduling
  • Business analytics and reporting

2. Accounts & Subscriptions

  • You must provide accurate information when creating an account.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • Subscriptions are billed monthly or annually depending on your selected plan.
  • The Pro plan includes a 30-day free trial on monthly billing. No charge is made during the trial period. A valid payment method is required to start the trial.
  • You may cancel your subscription at any time. Access continues until the end of the current billing period.
  • Timply reserves the right to suspend or terminate accounts that violate these terms.

3. SMS Messaging

Businesses on Pro or Agency plans are assigned a dedicated 10-digit long code (10DLC) phone number used to send transactional SMS messages to their customers on their behalf. By subscribing to a plan that includes SMS, you agree to:

  • Only send messages to customers who have explicitly opted in through the Timply booking flow.
  • Honor all opt-out requests immediately.
  • Not use Timply SMS infrastructure for marketing, promotional, or non-transactional messages.
  • Comply with TCPA, CTIA guidelines, and all applicable federal and state SMS regulations.

4. Payments & Fees

  • Subscription fees are charged at the beginning of each billing period.
  • A platform fee applies to all payments collected through Timply. This fee is deducted from the business owner's payout — customers are never charged extra:
    • 0.5% on Starter
    • 0.3% on Pro
    • 0.1% on Agency
  • All payments are processed by Stripe. Timply does not store payment card information.
  • All subscription fees are non-refundable.
  • Timply is a booking platform and is not a party to any transaction between a business and its customers. Any disputes regarding service quality, refunds, or cancellations are solely between the business and their customer. Timply has no obligation to mediate, intervene, or issue refunds on behalf of either party.

5. Acceptable Use

You agree not to:

  • Use Timply for any unlawful purpose or in violation of applicable regulations.
  • Attempt to reverse-engineer, hack, or misuse the platform or its infrastructure.
  • Send unsolicited or non-transactional SMS messages through the platform.
  • Impersonate any person or business.
  • Upload or transmit harmful, fraudulent, or abusive content.

6. Health Information & HIPAA

Timply is not a HIPAA-compliant platform and is not designed, certified, or intended for use by covered entities or business associates as defined under the Health Insurance Portability and Accountability Act (HIPAA).

You agree not to use Timply — including any notes, messaging, or free-text fields — to collect, store, or transmit Protected Health Information (PHI) as defined under HIPAA. This includes, but is not limited to, medical histories, diagnoses, treatment plans, prescription information, or any health data that can be linked to an identifiable individual.

Health-adjacent businesses (such as dental offices, med spas, massage therapists, chiropractors, or similar) may use Timply for general appointment scheduling provided they do not enter PHI into any field on the platform — including appointment notes left by customers, staff, or business owners.

Timply assumes no liability for any PHI inadvertently or intentionally entered into the platform by a business, its staff, or its customers. Businesses operating in regulated healthcare contexts are solely responsible for ensuring their use of Timply complies with all applicable laws, including HIPAA. If your use case requires HIPAA compliance, you must not use Timply until a compliant solution is made available.

7. Data & Privacy

Your use of Timply is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Timply, you consent to the data practices described therein.

8. Intellectual Property

All content, branding, code, and design elements of Timply are the property of NovaTechBase LLC and may not be reused, copied, or distributed without prior written permission.

9. Disclaimer & Limitation of Liability

Timply is provided “as is” without warranties of any kind. We do not guarantee uninterrupted availability or error-free operation. We are not liable for any indirect, incidental, or consequential damages arising from your use of the platform.

Timply is not responsible for the quality, fulfillment, or outcome of any service booked through the platform. All disputes between a business and their customers — including service quality, refunds, or no-shows — are the sole responsibility of the parties involved. Timply is not liable for and will not mediate any such disputes.

AI-generated responses from the voice booking agent are automated and may not always be accurate. Users engage with AI features at their own discretion.

10. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. Continued use of Timply after changes are posted constitutes acceptance of the updated terms.
